General Terms and Conditions for the Sale of Gift Vouchers and Experience Vouchers via the halbersbacher hospitality group gmbh online voucher portal.

I. Scope

These General Terms and Conditions (GTC) apply to the sale of gift vouchers and service recommendation vouchers via the online voucher portal of halbersbacher hospitality group gmbh at www.halbersbacher.de, as well as on the websites www.tannenhaeuschen.de and www.twicehotels.de.

II. Contracting Parties

Only persons who have reached the age of 18 are authorised to make purchases via the online gift voucher portal.
The contract is concluded between the customer, as the purchaser, and the

halbersbacher hospitality group gmbh
Mollistraße 10
18209 Bad Doberan

Represented by the managing director, Mr Arne Mundt
Register court: Rostock HRB: 14516

as the seller.

III. Conclusion of the contract

1. The products (vouchers) displayed on our online voucher portal are merely invitations to place an order (invitatio ad offerendum). They do not constitute a binding offer.

2. By placing an order by clicking on the ‘Place order (subject to payment)’ button, the customer makes a binding offer to conclude a contract of sale for the selected voucher(s). This order will be confirmed immediately to the email address provided by the customer.
The purchaser’s offer is accepted upon the provision of the ordered voucher(s) for download and printing (Print@home) on the online voucher portal and digitally via email.

3. If the relevant option is selected on the online voucher portal or when ordering by telephone, the voucher(s) ordered may be sent by post to the address provided by the customer. A postage charge of EUR 3.00 will be applied for this. The contract comes into effect upon dispatch of the voucher(s) ordered. In this case, halbersbacher hospitality group gmbh shall not be liable for any delays in the delivery of the voucher(s) by post.

4. Any incorrect details entered are the responsibility of the customer.

5. There may be discrepancies between the product descriptions and photographs. We reserve the right to correct errors and make changes to the items.

IV. Invoicing, VAT, Payment Terms

1. In accordance with statutory provisions (UStG), invoices showing VAT cannot be issued until the service has actually been provided. This is the time at which the voucher is redeemed.

2. None of the prices listed include VAT , as the voucher itself represents a 100% credit. VAT is only included on the actual invoice(s) issued by the hotel.

3. Payment of the purchase price is processed via the payment service provider Concardis. The following payment methods are available to the purchaser: credit card, PayPal and Sofortüberweisung.

V. Redemption

1. Vouchers for a specific value and service recommendations can only be redeemed at hotels belonging to halbersbacher hospitality group gmbh.

2. The vouchers ordered may be redeemed by the person presenting them.

3. The right to redeem the voucher expires 3 years after the end of the year in which the voucher was issued (as per the date of issue).

4. halbersbacher hospitality group gmbh is only obliged to redeem the value or service vouchers if the purchase price due has been paid in full.

5. The voucher value cannot be paid out in cash. If the price of the service for which the voucher is redeemed is less than the voucher value, the person redeeming the voucher will be issued with a voucher on the spot for the difference. The period during which the voucher for the difference may be redeemed corresponds to the remaining period during which the original, partially redeemed voucher may be redeemed.

VI. Liability

1. halbersbacher hospitality group gmbh shall be liable to the customer in all cases of contractual and non-contractual liability arising from wilful misconduct or gross negligence, in accordance with statutory provisions, for damages or reimbursement of wasted expenditure.

2. In all other cases, halbersbacher hospitality group gmbh shall be liable – unless otherwise provided for in paragraph 3 – only in the event of a breach of a contractual obligation, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the customer, as a consumer, could reasonably rely (a so-called cardinal obligation), and such liability is limited to compensation for foreseeable and typical damage. In all other cases, liability is excluded, subject to the provision in paragraph 3.

3. Liability for damage resulting from injury to life, limb or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

VII. Right of withdrawal

1. As a consumer, i.e. as a natural person placing an order for a purpose that cannot be attributed to their commercial or self-employed professional activity, the purchaser is entitled to a right of withdrawal in accordance with the statutory provisions.

2. If the customer, as a consumer, exercises their right of withdrawal in accordance with the preceding paragraph, they shall bear the standard costs of returning the goods.

3. In all other respects, the provisions set out in detail below apply to the right of withdrawal:

’s Cancellation Policy – Right of Cancellation

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you (other than the carrier), took possession of the goods.

To exercise your right of withdrawal, you must notify us

Halbersbacher Hospitality Group GmbH
Mollistraße 10
18209 Bad Doberan

represented by the managing director, Mr Arne Mundt
Register court: Rostock HRB: 14516

by means of a clear statement (e.g. a letter sent by post, a fax or an email) informing us of your decision to withdraw from this contract.

You may use the attached model withdrawal form (PDF) for this purpose, although this is not compulsory. You may complete the model withdrawal form and send it to us by email to info@halbersbacher.de. If you make use of this option, we will immediately send you (e.g. by email) confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send notification of your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods.

You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you post the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

You will only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to ascertain their nature, characteristics and functioning.

Please note that the right of withdrawal does not apply to contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, the carriage of goods, motor vehicle hire, the supply of food and drink, or the provision of other services in connection with leisure activities, where the contract specifies a particular date or period for the provision of the service. This exception does not apply to contracts for travel services under Section 651a of the German Civil Code (BGB) if these were concluded outside business premises, unless the oral negotiations on which the conclusion of the contract is based were conducted at the consumer’s prior request. The right of withdrawal lapses if the voucher(s) are redeemed by mutual agreement whilst the withdrawal period is still in force.

VIII. Final Provisions

1. The place of performance and payment is Bad Doberan.

2. The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the buyer has their habitual residence shall remain unaffected.

3. If the buyer does not have a general place of jurisdiction within Germany, or if they transfer their place of residence abroad after the conclusion of the contract, or if their place of residence is unknown at the time the action is brought, the place of jurisdiction for all disputes arising from the contract of sale shall be Bad Doberan.

4. Should any individual provisions of these General Terms and Conditions be or become invalid, or should they conflict with statutory provisions, this shall not affect the remainder of the contract. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective which the contracting parties intended to achieve with the invalid or unenforceable provision. The above provisions shall apply mutatis mutandis in the event that the contract proves to contain any omissions. In all other respects, the statutory provisions shall apply.
